Privacy policy

MAIN PURPOSE

1. This Privacy Policy applies to the processing and protection of personal data when browsing the website www.maskup.com.pl and each of its sub-sites (hereinafter referred to as the "Store"). These activities are performed by Maskup sp. z o.o. with its registered office in Katowice (ul. Teatralna 17A, 40-003Katowice), entered in the National Register of Entrepreneurs kept by the District Court of Katowice - Wschód in Katowice, under KRS number: 0000882270, NIP: 9542823352, REGON number: 388139332, hereinafter referred to as "Maskup".

2. The Privacy Policy contains all rules regarding the acquisition and processing of Users' data. This applies both to the organization of contests and orders placed by Users for goods and services offered by Maskup.

3. the main purpose is to provide Users of the Store with privacy protection at least at the level specified in applicable laws, in particular:

3.1. in the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2002, No. 144, item 1204, as amended),

3.2. in Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation - GDPR (OJ L 119, p.1),

3.3. and in the Law of July 16, 2004 (OJ L 119, p.1). Telecommunications Law (Journal of Laws of 2004, No. 171, item 1800, as amended).

 

PERSONAL DATA ADMINISTRATOR

(1) The administrator of the personal data of the Users of the Store is Maskup sp. z o.o., based at 17A Teatralna Street, Katowice, Poland.

(2) In matters related to the protection of personal data, the Customer may contact by writing to: info@maskup.com.pl or calling 789 266 629.

 

RULES FOR PROCESSING PERSONAL DATA

1. Submission of personal data by Store Users is voluntary.

2. Personal data of Store Users are processed:

2.1. for purposes related to registration in the Store,

2.2. each time an appropriate consent is given for marketing of products and services and use of Newsletter service,

2.3. transfer of Users' personal data to ING Bank Śląski S.A. ("Bank") in connection with:

2.3.1. rendering by the Bank to the Store the service of providing the infrastructure for handling payments over the Internet (legal basis: Article 6(1)(f) of the Regulation).

2.3.2. handling and settlement by the Bank of payments made by the Store's customers over the Internet using payment instruments (legal basis: Article 6(1)(f) of the Regulation).

2.3.3. in order for the Bank to verify the proper execution of contracts concluded with the Store, in particular to ensure the protection of the interests of payers in connection with their complaints (legal basis: Article 6(1)(f) of the Regulation).

2.4. transfer of personal data of Users to Twisto Poland sp. z o.o. in connection with the possibility of offering a payment for purchased products or services by Twisto Poland sp. z o.o. under a contract of mandate including a purchasing formula “Buy with Twisto” and making this purchase formula available by the Shop, as well as in order for Twisto Polska Sp. z o.o. to verify proper execution of such contracts of mandate (legal basis: art. 6, sec. 1, letter f) of the Regulation).

3. Processing of Users’ personal data for the purposes specified in paragraph 2 will be in connection with the existence of a legitimate interest pursued by the Store.

4. In connection with the processing of personal data for the purposes specified in paragraph 2, Users’ personal data may be made available by the Store to other recipients or categories of recipients of personal data, which may be:

4.1. ING Bank Śląski S.A.

4.2. Twisto Polska sp. z o.o.

5. In connection with the processing of Users’ personal data, they have the following rights:

5.1. The right to access their personal data,

5.2. Right to correct them if they are inconsistent with the actual state,

5.3. The right to delete or restrict processing of the data,

5.4. The right to object to the processing of personal data,

5.5. Right to data portability.

6. Where the processing of the User’s personal data is based on consent, the User has the right to withdraw such consent at any time. Withdrawal of consent does not affect the processing of data before the withdrawal of consent or the legal basis for such processing.

7. The supervisory authority for the Store’s personal data is the Inspector General for Personal Data. User has the right to lodge a complaint to the supervisory body.

8. In the event that the provision of personal data by Users takes place in order to conclude a contract with the Store, the provision of personal data by Users is a condition for the conclusion of this Agreement. Providing personal data in this situation is voluntary, but the consequence of failing to provide such data will be inability to conclude a contract with the Store.

In the event that the personal data provided by Users is transferred to Twisto Polska sp. z o.o. before conclusion of a contract of sale of products (or services) purchased in the Shop, the transfer of such data is a condition of conclusion of a contract of sale in connection with the business model adopted by the Shop. 

In the case of transfer of personal data of Users to the Bank in connection with the processing and settlement of payments made by Users to the Store via the Internet using payment instruments, data submission is required in order to make payments and to provide confirmation of its execution by the Bank to the Store. 

In the case of transfer of personal data of Users to the Bank in order to verify the Bank’s due performance of the agreements concluded with the Store, in particular to ensure the protection of the interests of payers in connection with their complaints, the provision of such data is required in order to enable the execution of the agreement concluded between the Store and the Bank. 

In the event of transferring Users’ personal data to Twisto Poland sp. z o.o. in connection with the possibility of offering Users the payment of a price for purchased product or service through Twisto Poland sp. z o.o. as part of an order agreement including a purchasing formula “Buy with Twisto” and making that formula available by the Store, the submission and processing of that data for that purpose is required in connection with the business model adopted by the Store and in order to fulfil the agreement concluded between the Store and Twisto Poland sp. z o.o.

9. In the case of any purchase of goods, personal data will be processed in order to properly perform the sales contract of the purchased products, as well as their delivery. Failure to provide personal data necessary to conclude a sales agreement results in refusal to conclude this agreement.

10. The legal basis for the processing of personal data in the scope of User’s registration in the Store and use of the Newsletter service is the granted consent. In case of purchase of goods the processing of data the above mentioned consent is necessary for the purpose of execution of the agreement.

11. Personal data will be stored until the withdrawal of consent by the User or the expiry of a maximum of 5 years from the moment of completing the order.

12. Users’ personal data shall be transferred to entities providing services in the field of ICT, legal and marketing activities, as well as to entities delivering goods. Users’ personal data are not passed on to third parties.

13. Some or all personal data collected during registration or ordering in the Store will be used to create a Customer Account, as well as to process and complete orders.

14. Personal data collected by the Store may be used to create a User profile in order to provide relevant information when browsing the Store and in the Newsletter. At all times, the processing of this personal data will be carried out in accordance with legal regulations.

15. Data collected automatically is used to manage the Store, detect security breaches, study User traffic in the Store and for statistical purposes. This includes the use of Google Analytics in order to collect information regarding User location, IP address, date and time of the connection, source and number of connections, viewed subpages of the Store or in order to personalise the content of the Store and its subpages. This data will not be combined with User’s personal data, nor will it be used to determine the identity of a specific User.

16. The type of data collected automatically depends on the settings of the Internet browser selected by the User. All Users are recommended to verify the settings of their web browser in order to determine the type of information that is automatically disclosed by the browser or modify the settings accordingly. Users are advised to consult the Help section of their Internet browser.

17. Location data, when activated by the User, is used to customize Store content to provide location-based information, including but not limited to providing the location of the store closest to the User’s location.

18. Under the law, there may be a legal obligation to disclose data such as a Website User’s IP address to public authorities upon request.

 

TERMS AND CONDITIONS OF PERSONAL DATA PROCESSING

  1. Personal data are processed with the consent of the User whose data is to be processed. They are also processed when Maskup, as the controller of the personal data, has the right to do so under the law.
  2. The User’s consent to the processing of personal data is given primarily by ticking a specific box, indicated during each procedure to enable the use of selected functions of the Store, e.g. when filling in a form.
  3. Maskup does not disclose personal information to third parties unless:
    3.1. The User has given permission to do so (e.g., if the User has received a prize, his or her contact information may be disclosed to the courier company responsible for delivering the prize; if the user has placed an order for goods or services offered by Maskup, relevant data may be disclosed to entities involved in fulfilling the order),
    3.2. or where disclosure of personal data is required by law.
  4. As the controller of personal data, Maskup has the right to entrust the processing of personal data collected through the Store to an external entity under a written contract.

 

USERS' RIGHTS

  1. Users have the right to request access to their data, to modify, transfer and delete their data, and to restrict the processing of their data.
  2. Maskup will not make automated decisions based on Users’ personal data, in particular decisions resulting from profiling based on the Customer’s personal data.
  3. Users have the right at any time to withdraw their consent to the processing of personal data that are processed on the basis of explicit consent. Withdrawal of consent will not affect the lawfulness of processing of personal data performed on the basis of the consent given before its withdrawal.
  4. The User may at any time change the electronic mail address (e-mail address) to which the Newsletter is sent or resign from the service consisting in free delivery of the Newsletter by clicking on the Newsletter link located in the footer of each Newsletter, entering their e-mail address in the appropriate field, and then selecting the “Cancel subscription” button.
